Terms of service.

1. Definitions

  • "Company," "We," "Us," or "Our": Refers to SkyTech Drone Services, LLC.

  • "Client," "You," or "Your": Refers to the individual or entity engaging our services.

  • "Services": Refers to all drone-related services provided by SkyTech Drone Services, LLC., including but not limited to surveying, imaging, thermal surveys, and video production.

2. Ownership and Operation of Equipment

SkyTech Drone Services, LLC. is the sole owner and operator of all drones, equipment, and software used to provide Services. All equipment remains the property of SkyTech Drone Services, LLC. and may not be used by Clients for any unauthorized purposes.

3. Assumption of Risk and Limitation of Liability

  • No Liability for Damage: SkyTech Drone Services, LLC. assumes no liability for any damage to property or life that may occur during the course of any operation or contracted work. This includes, but is not limited to, incidental, consequential, or punitive damages arising from the use of our Services.

  • Compliance with Regulations: All operations are conducted in accordance with Federal Aviation Administration (FAA) 14 CFR Part 107, sUAS regulations, and the Texas Parks and Wildlife Department (TPWD) Aerial Wildlife Management Permit (AWM). Our operators are licensed by the FAA under 14 CFR Part 107.

  • Permits and Authorizations: Prior to any operation involving wildlife, SkyTech Drone Services, LLC. will obtain the necessary AWM Permit and Letter of Authorization from TPWD, granting us permission to perform specific operations on designated properties.

4. Client Responsibilities

  • Acknowledgment of Terms: By engaging our Services, Clients acknowledge and accept these Terms and assume all liability for any services rendered by SkyTech Drone Services, LLC.

  • Property Access: Clients must ensure that SkyTech Drone Services, LLC. has the necessary permissions and access rights to perform Services on the specified property.

5. Payment Terms

  • Invoicing: All Clients will be invoiced via Square. Invoices are due within seven (7) business days from the date of issuance.

  • Late Fees: Invoices not paid within the specified term will incur a late fee of twenty percent (20%) of the total invoice amount. For each additional thirty (30) days that the invoice remains unpaid, an additional twenty percent (20%) late fee will be applied.

6. Payment Methods

Payments can be made through Square using accepted payment methods, including credit/debit cards and electronic transfers. Clients are responsible for ensuring that their payment information is accurate and up-to-date. All payments will incur a 3% card processing fee.

7. Indemnification

Clients agree to indemnify, defend, and hold harmless SkyTech Drone Services, LLC., its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with the Client’s use of the Services or breach of these Terms.

8. Insurance

While SkyTech Drone Services, LLC. maintains appropriate insurance coverage for its operations, Clients are advised to secure their own insurance coverage as needed. SkyTech Drone Services, LLC. does not provide insurance for Clients' properties or assets.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

10. Dispute Resolution

Any disputes arising out of or related to these Terms or the Services provided by SkyTech Drone Services, LLC. shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Texas, and the language of the arbitration shall be English. The venue will be set in Frio County, Texas.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. Such provisions shall be deleted without affecting the remaining provisions herein.

12. Amendments to Terms

SkyTech Drone Services, LLC. reserves the right to modify or amend these Terms at any time. Any changes will be effective immediately upon posting on our website. Clients are responsible for reviewing these Terms periodically to stay informed of any updates. Continued use of our Services after any such changes constitutes acceptance of the new Terms.

13. Termination

SkyTech Drone Services, LLC. reserves the right to terminate or suspend Services immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms by the Client.
